How is a will made?

A will is a legal document that allows a person (called the testator) to express his or her will on how his or her assets and property will be distributed after his or her death. It is an act of great importance, as it avoids conflicts among heirs and ensures that the wishes of the deceased are carried out.

  1.  Holographic will. It is the one written by hand, dated and signed by the testator himself. This type of will is free, but it has the disadvantage that it can be contested if the legal regulations have not been followed correctly.
  2.  Open will. It is granted before a notary. The notary is in charge of drafting the will according to the testator's instructions and attests to the testator's capacity to testament. It is more expensive than the holograph, but offers more legal certainty.
  3. Closed will. It is handwritten by the testator, but is kept in a sealed and sealed envelope which is deposited before a notary. The notary attests to the deposit of the will, but does not know its contents. It is less common than the previous ones. 

What can be included in a will?

Broadly speaking and in a summarized form, in a will you can add:

  • The designation of the heirs and the distribution of the assets among them.
  • The appointment of a guardian for minor children.
  • The designation of an executor, who is the person who will be in charge of executing the will of the testator.
  • The expression of other wills, such as the form of the funeral or organ donation.

How much does it cost to make a will?

The cost of a will depends on the type of will to be made and the notary before whom it is granted. In general terms, the cost of making a will in Spain is usually around 50 euros, with the most common range being between 35 and 70.
