If you find yourself in an employment situation that you consider unfair or that infringes your rights, it is important to know what your rights are. In Spain, employment law grants workers a series of fundamental rights that protect their interests as an employee. At LVG Legal, our law firm specialising in employment law (among other branches) in Ourense, Monforte and Madrid, we will clarify in this article when and what you can claim.
What are my rights as an employee?
The Workers' Statute is the main law that regulates labour relations in Spain. Among the most important rights guaranteed are:
- Salary . You have the right to receive a fair salary within the established timeframe, including all corresponding bonuses and supplements.
- Working hours. The maximum working hours are legally established, and employees have the right to enjoy daily, weekly and holiday breaks.
- Vacation . You are entitled to a certain number of days of paid vacation each year.
- Social Security. Your employer must register you with Social Security and pay the corresponding contributions to ensure your protection in the event of illness, accident, unemployment, etc.
- Prevention of occupational risks . The company has the obligation to guarantee a safe and healthy work environment, adopting the necessary measures to prevent accidents and occupational diseases.
- Non-discrimination. You have the right not to be discriminated against on the basis of sex, race, religion, political opinion, disability, sexual orientation, gender identity or any other condition.
- Freedom of association. You can join a trade union and take part in trade union activities.
- Collective bargaining . You have the right to participate in collective bargaining through your union representatives.
What can I claim if my rights are violated?
The legal actions you can take will depend on the specific infringement committed. Some of the most common claims are:
- Non-payment of wages. You may demand the amounts owed, as well as the corresponding legal interest.
- Unfair dismissal. If you consider that your dismissal was not justified, you can request the corresponding compensation.
- Mobbing or workplace harassment. If you are a victim of psychological harassment at work, report it and claim compensation.
- Employment discrimination . If you have been discriminated against, you may be able to file a lawsuit and seek compensation for damages.
